DMCA Copyright Policy
Digital Millennium Copyright Act Compliance
Overview
ProConnect respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.
Important Notice
Users who upload content to ProConnect are solely responsible for ensuring they have the legal right to use that content. ProConnect acts as a service provider under the DMCA and is not liable for user-uploaded content.
Filing a DMCA Takedown Notice
If you believe that content on ProConnect infringes your copyright, you may submit a DMCA takedown notice. To be valid under the DMCA, your notice must include:
- Identification of the copyrighted work: Describe the copyrighted work that you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material: Provide the specific URL(s) or location(s) of the content you claim is infringing.
- Your contact information: Include your name, address, telephone number, and email address.
- Good faith statement: Include the following statement: "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
- Accuracy statement: Include the following statement: "The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
- Physical or electronic signature: Provide your physical or electronic signature.

Our Response Process
Upon receiving a valid DMCA notice, ProConnect will:
- Remove or disable access to the allegedly infringing content within 24-48 hours
- Notify the user who uploaded the content that it has been removed
- Provide the user with a copy of the DMCA notice
- Track copyright strikes against the user's account
Counter-Notification
If you believe your content was removed in error or that you have the legal right to use the content, you may file a counter-notification. Your counter-notification must include:
- Your name, address, telephone number, and email address
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
- A statement consenting to jurisdiction in your district (or where ProConnect is located)
- Your physical or electronic signature

Repeat Infringer Policy
ProConnect maintains a three-strike policy for copyright infringement:
Strike 1: Warning email sent, content removed
Strike 2: Final warning, content removed, 7-day account suspension
Strike 3: Permanent account termination
We reserve the right to terminate accounts with fewer strikes in cases of egregious or willful infringement.
Misrepresentation
Under the DMCA, any person who knowingly materially misrepresents that content is infringing or was removed by mistake may be liable for damages. Please ensure your DMCA notice or counter-notification is accurate.
Fair Use Disclaimer
ProConnect does not make determinations about fair use. Many coaching uses of reference content may qualify as fair use under 17 U.S.C. § 107, particularly when used for criticism, comment, teaching, or educational purposes. However, fair use is decided on a case-by-case basis and users assume all risk for their use of copyrighted materials.
